Montana law requires tenants to seek the written consent of the landlord (or the landlord`s agent) to sublet real estate. According to the owner-tenant guide established by the Michigan legislature, if the lease does not mention subletting (authorized or restrictive), tenants can legally sublet their rent without the landlord`s permission. It should be noted, however, that in most cases tenants should be expected to first obtain the agreement of their landlords. All incidental costs (including electricity, heat and water) for premises to be paid by the subtenant under its lease agreement must be paid by the subtenant for the duration of the sublease. .
